Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Caliber LLC (“Natural Touchpoint,” “we,” “us,” or “our”) governing your access to and use of the Natural Touchpoint website, application, and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Natural Touchpoint helps you keep up with people you choose to follow by assembling a personalized email brief of relevant public updates about them — such as job changes, company news, birthdays, press mentions, and posts from social accounts you connect. The Service depends on data from sources and integrations you authorize, and its content is provided for your personal information only.

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.

You are responsible for the information you provide, for maintaining the security of your account and credentials, and for all activity under your account. Notify us promptly at hello@naturaltouchpoint.com of any unauthorized use.

Natural Touchpoint is provided to you free of charge. There is no subscription fee, and we do not require payment or payment information to create an account or use the Service.

If we ever introduce optional paid features in the future, they will be clearly identified as optional and we will provide advance notice; we will not begin charging you for the features you use today without your consent.

The Service lets you connect third-party accounts (such as Google, Microsoft, Apple, and social platforms) and acts on your behalf and with your authorization to access information you are entitled to access.

• You authorize Natural Touchpoint to access and process data from accounts you connect, as described in the Privacy Policy, and you may disconnect them at any time.
• Your use of third-party accounts through the Service is also subject to those third parties’ own terms and policies. You are responsible for ensuring your use is consistent with them, and we are not responsible for third-party services, their availability, or changes they make.
• We access only what is needed to provide the Service, and we do not post, message, or make changes on your behalf.

You agree not to: use the Service in violation of any law or third-party right; use it to harass, stalk, harm, or infringe the privacy of any person, or in a manner inconsistent with the reasonable expectations of the people you follow; attempt to access accounts or data you are not authorized to access; resell, scrape, or redistribute the Service or its content except as expressly permitted; interfere with or disrupt the Service or attempt to circumvent its security or usage limits.

You are responsible for the people you choose to add and for using the information the Service provides responsibly and lawfully.

• Your content. You retain rights to the information you provide and the accounts you connect. You grant us a limited license to host, process, and use that information solely to operate and improve the Service as described in the Privacy Policy.
• Our content. The Service, including its software, design, and branding, is owned by Natural Touchpoint and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use, subject to these Terms.

The Service assembles information from public and third-party sources and automated systems. We work to keep briefs accurate and relevant, but we do not guarantee that any update is complete, accurate, current, or free of errors, and the Service may miss or misattribute items. Briefs are provided for informational purposes only and are not professional, legal, financial, or other advice. You are responsible for verifying information before relying on it.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATURAL TOUCHPOINT AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED US $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless Natural Touchpoint from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your content or connected accounts, or your violation of these Terms or of any law or third-party right.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (such as Sections 8–11) will survive.

We may modify the Service or these Terms. If we make material changes to these Terms, we will provide notice (for example, by email or in-Service notice) and update the “Last updated” date. Your continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to their jurisdiction.
